General Terms and Conditions (AGBs)

§ 1 Application field
Our listed contract terms are valid for the delivery and sales particularly for long-distance sales as compared to private consumers and other customers. As opposed to consumers that are not private customers, the terms of contract are valid only with the stipulation, that the right of return as described in more detail in § 8 does not apply. In principle, the right of return applies only for long-distance sales businesses. Deviations in the General Terms and Conditions are only valid, if these are expressly agreed upon by us.

§ 2 Commitment to contract
by your telephone or written order and our corresponding confirmation, a legally valid contract is in force between you and us.

§ 3 Availability of the contract text
The contract text is available exclusively in the German language. The contract text is sent to you after a completed order or at the latest with the delivery for renewed information. The contract text is also accessible, printable and able to be stored at any time on the website under the menu item "Legal Notice / terms & conditions".

§ 4 Composition and essential features of the products
The composition, features and the quality of the delivered products are found in the composition listings in the respective product specifications, which is accessible on our website.

§ 5 Non-availability of the products
The completion of the contract is carried out under the reservation of our sub-supplier delivery; the reservation is only valid for consumers, provided that we have completed a concrete covered transaction and are not supplied by the supplier, through no fault of our own. We will immediately inform the customer about the non-availability of the product and immediately refund possible payments/services to the customer.

§ 6 Prices, delivery and payment conditions
All indicated prices are understood to include the legally valid sales tax at the time of the performance of service. Products which are in stock are delivered to the shipping department within 5 working days. If the product is not on stock at the time of the order, we will immediately order the product and inform the customer concerning this and about the expected delivery date. The payment for the product is carried out alternatively by payment in advance or payment on delivery.

§ 7 Guarantee
Our guarantee obligation, which means the obligations concerning the delivery of faulty products, follow the general legal regulations. It is to point out explicit that the installation of tuning products can shorten the service performance of the motor / aggregates. The installation leads to the loss of the guarantee or warranty of the vehicle manufacturer and/or the vehicle salesman. The performance improvement of vehicles requires a new typification regarding the motor vehicle liability insurance and comprehensive insurance. As far as specific something else is not arranged, our articles are delivered and or owed without TÜV expert opinion / ABE. The buyer is self beholden even to take care for the maintenance of the insurance protection. The use in the public traffic results on own danger. In the commercial business, the guarantee time period is restricted on a year. Returns will only be accepted, if they are sent without postage due and with the service number to be obtained from us. Service updates from the manufacturer, which require us to make a unit or software update, are executed only depending on amount of effort calculated against payment. No liability for the function of our products is assumed by us for third party to control unit updates. Possible complaints are to be sent to:

§ 8 Right of return
You have the right to return the received product without detailing of reasons within two weeks by return mail. Details for this have to be taken from the separate return instructions according to the contract text. There are exceptions to the right of return for the delivery of goods which are customized according to customer specification or are obviously tailor-made to personal needs.

§ 9 Right of ownership / Lien
The delivered products remain our property until complete payment has been made.

§ 10 Saving of data, information protection
We handle all personal data obtained from you as strictly confidential. The data necessary for the execution of the contract are saved and processed electronically, as far as this is necessary for the carrying out and execution of the contract. Collection of data, transmission of data and / or other processing of obtained personal data for other uses is not carried out by us.

§ 11 Compensation for damages
The liability is restricted to typical, foreseeable damages for non-deliberate and non-grossly negligent violations of a contractual obligation by us. The understood limitation of liability is not valid for the event of injury to life, body or health. The limitation of liability is not further valid, if the customer asserts claims for product liability.

§ 12 Applicable law
The laws of the Federal Republic of Germany exclusively apply for all deliveries.

§ 13 Areas of jurisdiction and other determinations
It is agreed that our place of business is the area of jurisdiction, if you are a merchant or do not have any general area of jurisdiction in the Federal Republic of Germany. If single regulations should be ineffective, this doesn't lead to the ineffectiveness of the complete contract as well as the other contractual regulations. The ineffective regulation is replaced by the corresponding legal rule.

Return instructions

Right of return:

You can return received products without detail of reasons by return mail within two weeks. The period starts, at the earliest, with the receipt of the product and this instruction. You can request in writing, also by letter, fax or e-mail for a return of the product only for products not able to be sent per postal package (e.g. bulky goods). To preserve the deadline period, products should be punctually returned or the request for return punctually sent. In any case, the return is carried out at our expense and risk. Consequences of return:

In the case of an effective return, both parties are to receive in return any received services/funds and if necessary any received benefits of usage. A compensation can be required by a deterioration of the product. This is not valid if the deterioration of the product is exclusively from examination, such as if it can be led back to the store. You can possibly avoid the value compensation obligation to by the fact that you take the product not as an owner in use and refrain from everything which impairs its value.
